These Terms and Conditions (“Terms”) govern your use of our services. Throughout these Terms, the terms “Find a Sail,” “we,” “us,” and “our” refer to Find a Sail, while “you” and “your” refer to users of our services. The “Site” refers to our website (*.findasail.com), and the “Platform” includes our Site, applications, and related services.
By using our platform, you agree to comply with and be bound by these terms and conditions. These terms ensure a safe, fair, and enjoyable experience for all users.

The Find a Sail Platform
Scope of Service
Find a Sail provides an online platform that connects sailing enthusiasts (“Users”) with sailing schools and experience providers (“Providers”). Users can search for, book, and participate in sailing courses, charters, and other sailing experiences (“Sailing Experiences”) offered by Providers. Please note that Find a Sail does not handle payments or manage Sailing Experiences as these are the responsibility of the Providers.

User Registration and Accounts
Creating an Account
To access and use Find a Sail, you’ll need to create an account. Ensure your account information is accurate and updated. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account.
Age Requirement
You must be at least 16 years old to register and use our platform. Users under 16 are not permitted to create an account or use our services.
User Responsibilities
Community Conduct
As a user, you must:
- Respect and adhere to our Community Guidelines.
- Comply with all applicable laws and regulations.
- Take responsibility for your actions and the actions of any guests you invite to participate in Sailing Experiences.
- Provide accurate information and maintain the security of your account.

Booking Sailing Experiences
User and Provider Responsibilities
When you book a Sailing Experience through Find a Sail, you are entering into a contract directly with the Provider. All payment and booking terms, including cancellations, are subject to the Provider’s terms and conditions. Find a Sail may charge Providers a fee for connecting them with users.

Safety and Security
Safety First
Safety is paramount in sailing. Always follow safety guidelines provided by the Providers during Sailing Experiences. If you have any safety concerns, please report them promptly to our support team.

User-Generated Content
Content Standards
You are responsible for the content you post on our platform. Ensure your content is legal, respectful, and aligns with our Community Guidelines. We reserve the right to remove content that violates these standards.

Communication
Respectful Interaction
Maintain respectful communication with other users and Providers. Spamming or sending unsolicited messages is prohibited. All interactions should be conducted through our platform to ensure transparency and safety.

Honest Reviews
We encourage you to share honest feedback and reviews about your Sailing Experiences. Refer to our Review Guidelines for more information on how to submit constructive and helpful reviews.

Liability and Dispute Resolution
Liability Policy
Use at Your Own Risk:
- Overview: Your use of the Find a Sail platform is entirely at your own risk.
- Details: We disclaim all liability for any direct, indirect, incidental, or consequential damages arising from the use of our platform or the services provided by third-party sailing schools and experience providers.
Role of Find a Sail:
- Facilitation Only: We act solely as a facilitator, connecting users with sailing schools and experience providers.
- No Control: We do not own, manage, or control any of the services provided by third-party providers, and we are not responsible for the quality, safety, legality, or suitability of these services.
User Responsibility:
- Safety: Users are responsible for their own safety and the safety of any guests they bring to sailing experiences.
- Guidelines Compliance: It is crucial to follow all safety guidelines provided by the sailing experience providers.
Payment and Financial Disputes:
- Direct Transactions: All financial transactions and payment-related disputes are between the user and the provider. Find a Sail does not manage or intervene in these transactions.
- No Mediation in Payments: We are not responsible for resolving payment disputes between users and providers.
Limitation of Liability:
- Scope: To the fullest extent permitted by law, we limit our liability for any claims, damages, or losses that may arise from using our platform.
- Exclusions: This includes, but is not limited to, any errors, omissions, interruptions, or delays in the services provided by Find a Sail or its third-party partners.
Indemnification:
- User Agreement: Users agree to indemnify and hold Find a Sail and its affiliates harmless from any claims, losses, damages, or liabilities arising from their use of the platform or any violation of these Terms and Conditions.
- Scope of Indemnification: This includes legal fees and expenses incurred in connection with such claims.
Dispute Resolution
- Initial Resolution: Users and providers should first attempt to resolve any disputes directly, particularly those related to the sailing experience.
- Support Assistance: If a resolution cannot be reached regarding platform-related issues, contact Find a Sail support for assistance.
- Mediation and Arbitration: If direct negotiation fails, disputes may be resolved through mediation or arbitration, as agreed upon by the parties involved.
- Jurisdiction: Any legal proceedings related to platform disputes will be governed by the laws of Czechia and handled in Czech courts.

Termination and Account Closure
Account Management
We reserve the right to terminate accounts that violate our terms, guidelines, or policies. Users can also choose to close their accounts at any time by contacting our support team.

Find a Sail shall not be liable for any failure or delay in performing our obligations under these terms if such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to natural disasters, war, strikes, government regulations, pandemics, or other unforeseeable events.
